Terms of Service

These Terms of Service ("Terms") are an agreement between you and Most Sane Studios LLC ("Most Sane Studios", "we", "us" or "our"). They govern your use of all of our games and applications, including Weavs, and any websites, servers and services we provide (together, the "Services").

By downloading, installing, accessing or playing the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old to use the Services, except that children aged 10 to 12 may play games rated for mixed ages through a parent-managed Meta account. Children under 10 may not use the Services. If you are under 18 (or the age of majority where you live), you may only use the Services with the permission of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the Services.

You also need a valid account with the platform you play on (such as Meta Horizon), and you must follow that platform's own terms.

2. Your License to Play

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to install and use the Services for your own personal, non-commercial entertainment.

The Services are licensed to you, not sold. We and our licensors keep all rights not expressly granted to you in these Terms.

3. What You May Not Do

To keep the game fair, safe and working for everyone, you agree that you will not, and will not help or allow anyone else to:

• Reverse engineer, decompile, disassemble, decrypt or otherwise try to derive the source code, assets, network protocols or underlying structure of the Services, except where applicable law expressly allows it despite this restriction.
• Hack, cheat, or use any mod menu, trainer, injector, aimbot, speed hack, bot, script, macro or other unauthorized third-party software or hardware that modifies, automates or interferes with the Services.
• Modify, patch, repackage or redistribute the game client, its files or its memory, or create or distribute derivative works of the Services.
• Access or attempt to access our servers, backend, databases, APIs or other players' accounts in any way other than through the unmodified game client as intended.
• Intercept, emulate, spoof, redirect or tamper with network traffic or communications between the game client and our servers or other players.
• Data mine, scrape or extract unreleased content, assets or information from the Services, or leak it publicly.
• Exploit bugs, glitches or design errors to gain an advantage, or fail to report them to us when you find them.
• Interfere with, overload or disrupt the Services, our servers or networks, including through denial-of-service attacks, crashing other players or flooding.
• Get around, disable or interfere with any security, anti-cheat, moderation, age-gating or access-control feature of the Services.
• Buy, sell, rent, trade or give away accounts, or sell or trade virtual items or currency for real money or anything outside the game ("real-money trading").
• Use the Services for any commercial purpose, such as advertising or soliciting, without our written permission.
• Impersonate any person, including Most Sane Studios staff or moderators, or misrepresent who you are.
• Use the Services in any way that breaks any law or regulation.

4. Player Conduct

Our games are social, and many have voice chat. Treat other players with respect. You agree not to:

• Harass, bully, threaten, stalk or intimidate other players.
• Use hate speech, slurs, or content that discriminates based on race, ethnicity, religion, gender, sexual orientation, disability or any other protected characteristic.
• Share sexual, graphic, violent or otherwise inappropriate content, or behave inappropriately toward minors.
• Share your own or anyone else's personal information (such as real names, addresses, phone numbers or social media accounts).
• Grief, spam, or deliberately ruin the game for others.
• Choose a username or name tag that is offensive, misleading or infringes someone else's rights.

You can report players who break these rules using the in-game reporting tools.

5. Virtual Items and Currency

The Services may include virtual currency, cosmetics and other virtual items ("Virtual Items"), which you may earn in-game or buy with real money through the platform store.

• Virtual Items have no real-world monetary value and cannot be redeemed for cash or exchanged for anything outside the Services.
• When you get a Virtual Item, you receive a limited license to use it within the Services; you do not own it.
• Purchases are processed by the platform you play on and are subject to its payment and refund policies. Except as required by law or by that platform's policies, all purchases are final and non-refundable.
• We may change, rebalance or remove Virtual Items as part of running and updating the game.
• Virtual Items may be lost, without refund, if your account is suspended or terminated for breaking these Terms.

6. Your Content

Anything you create, say or submit through the Services, including usernames, voice chat, messages, reports and feedback ("User Content"), must follow these Terms. You give us a worldwide, royalty-free, non-exclusive license to use, host, store, reproduce, display and transmit your User Content as needed to operate, moderate and improve the Services.

If you send us ideas or feedback, we may use them freely without any obligation to you.

7. Our Intellectual Property

The Services and all of their content, including code, characters, art, models, audio, music, text, logos and trademarks, are owned by Most Sane Studios or its licensors and are protected by copyright, trademark and other laws. Nothing in these Terms gives you any right to use our names, logos or trademarks.

You may record and share gameplay videos and streams of the Services, including monetized ones, as long as you don't suggest they are made or endorsed by us and you follow these Terms.

8. Enforcement, Suspension and Termination

We may monitor the Services and investigate suspected violations of these Terms. If we believe you have broken these Terms or put other players or the Services at risk, we may, at our sole discretion and with or without notice:

• Issue a warning, mute you or remove you from a session;
• Temporarily or permanently ban your account, device or hardware;
• Remove or reset progress, Virtual Items or currency gained through cheating or exploits;
• Report illegal activity to the relevant authorities.

You may stop using the Services at any time. Sections of these Terms that by their nature should survive termination (including Sections 3, 5, 7 and 10–14) will survive.

9. Changes to the Services

The Services are a live game and will change over time. We may add, change, suspend or remove any part of the Services, including features, content and Virtual Items, at any time. We may also shut down the Services entirely. We are not liable to you for any of these changes.

Updates may be required to keep playing. The Services rely on third-party providers (such as Meta and our networking and hosting providers), and their availability is not guaranteed.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT YOUR DATA OR PROGRESS WILL ALWAYS BE PRESERVED.

We are not responsible for the conduct of other players, online or offline.

11. VR Health and Safety

Virtual reality can cause motion sickness, discomfort, eye strain, seizures and injury. Read and follow your headset manufacturer's health and safety warnings. Play in a clear, safe space, take regular breaks, and stop immediately if you feel unwell. You use the Services at your own risk.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MOST SANE STUDIOS AND ITS OWNERS, EMPLOYEES, CONTRACTORS AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, PROGRESS OR VIRTUAL ITEMS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE SIX MONTHS BEFORE THE CLAIM AROSE, OR (B) US $100.

Some jurisdictions do not allow certain of these limitations, so some of them may not apply to you.

13. Indemnification

You agree to defend, indemnify and hold harmless Most Sane Studios and its owners, employees, contractors and partners from any claims, damages, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Services.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware and applicable federal law of the United States, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us first and try to resolve the dispute informally for at least 30 days. Nothing in these Terms limits any rights you have under the consumer protection laws of the country where you live.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will change the "Last Updated" date above and, for significant changes, may notify you in-game or on this website. If you keep using the Services after the changes take effect, you accept the updated Terms.

16. General

These Terms and our Privacy Policy are the entire agreement between you and us about the Services. If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce any part of these Terms is not a waiver. You may not transfer your rights under these Terms; we may transfer ours.
